Welcome to Guru’s Choice’s Terms and Conditions of Use (“Terms”). This is a binding agreement between you and Linked Data LLC (“we,” “us,” or “our”). By accessing, viewing, or using Guru’s Choice (“App”), you agree to comply with these Terms. Please read carefully before proceeding.

Automatic Subscription Renewal

If you subscribe to services for a set term (“Initial Term”), your subscription will automatically renew for the same duration at the current fee unless canceled in accordance with Section 5.

Arbitration Agreement

Section 13 of these Terms governs dispute resolution. It includes an arbitration agreement that requires most disputes to be resolved through binding arbitration rather than in court. If you signed up before January 18, 2021, you may opt out of arbitration per Section 13.

California Subscribers Notice

California subscribers can cancel and request refunds within three business days of subscribing. Refunds are handled differently based on the platform used to subscribe:

To use the App, you must:

  1. Be at least 18 years old or the legal age of majority in your home country.
  2. Be legally permitted to use the App in your country.

Accounts can be created using Apple ID or Facebook login. If using Facebook, we may access and use certain profile details as outlined in our Privacy Policy.

Account Restrictions:

We monitor accounts and reserve the right to terminate or suspend accounts without prior notice if Terms are violated.

2. Types of Content

Guru’s Choice contains three types of content:

  1. Your Content: Content uploaded by you.
  2. Member Content: Content shared by other users.
  3. Our Content: Content owned or licensed by Linked Data LLC.

4. Privacy

Your personal data is collected and used in accordance with our Privacy Policy. By using the App, you agree to this policy.

5. Payment Terms

In-App Purchases

Purchases can be made through:

  2. Credit card, debit card, or PayPal.

Subscriptions and Auto-Renewal

Subscriptions renew automatically unless canceled before the end of the current period. Deleting the App does not cancel subscriptions.

Refunds

Refunds are generally not provided, except where required by law. Specific refund policies vary by platform (Apple, Google, or direct purchases).

6. Virtual Items

Virtual Items are non-transferable, non-refundable, and limited licenses governed by these Terms. We may modify or discontinue Virtual Items at any time.

7. Notifications and Location-Based Features

We may send notifications related to App features, offers, and updates. Opt-out options are available through your device settings.

Location-based content requires enabling location services on your device.

8. COVID-19 Disclaimer

COVID-19 data provided in the App is self-reported and unverified. Use caution when meeting people in person.

9. Disclaimer

The App and all content are provided “as is” without warranties. We do not guarantee uninterrupted or error-free service. Use the App at your own risk.

10. Limitation of Liability

We are not liable for indirect, incidental, or consequential damages arising from your use of the App. Our maximum liability is limited to $100, where applicable by law.

11. Indemnity

You agree to indemnify and hold us harmless from claims arising from:

  1. Your content or actions on the App.
  2. Violations of these Terms.

13. Dispute Resolution

Arbitration Agreement

Most disputes must be resolved through binding arbitration. Exceptions include small claims and intellectual property disputes. Arbitration is governed by JAMS rules.

You may opt out of arbitration within 31 days of accepting these Terms by emailing Guru’s Choice with your details and an opt-out request.

14. Termination

These Terms remain effective until terminated. You may terminate by closing your account. We reserve the right to suspend or terminate accounts for violations.

15. Governing Law

These Terms are governed by the laws of California. Disputes not subject to arbitration will be litigated exclusively in Los Angeles County, California.
